Divorce

From issues of child custody and support to the fair and equitable distribution of assets, you want what is best for you and your children. Alimony / Spousal Support

Effective September 10, 2014, major changes were made to the Alimony laws in the State of New Jersey. We will do everything we can to help you to apply the new changes in the law to reach the best possible outcome for you in your case.

Child Custody

New Jersey recognizes two kinds of custody: physical and legal. Physical custody is where the child or children live and go to school. This involves the actual physical care of the child. Legal custody involves the right of a parent to make decisions affecting the rearing of the child. Questions of education, religious indoctrination, medical care and other related matters are questions of legal custody. Courts may award both physical and legal custody to either parent, without favoring one or the other with regard to the parent's sex.

The courts are slowly adopting modern terminology for "physical custody" and "visitation." We now speak in terms of the Parent of Primary Residence (PPR) and the Parent of Alternate Residence (PAR). Basically, the legal meaning is the same. The number of overnights that the child or children spend with one parent or the other can impact the child support calculation.

International Travel with Children / Passports

International travel, with limited exceptions, cannot occur without an Passport. If a passport is issued, the parties have no means to prevent the other parent from travelling internationally unless there are restrictions in a court order. However, even though an order exists, the United States does not have any system to regulate travel restrictions imposed by a New Jersey Court order.

Child Support

Child support is set by the "New Jersey Child Support Guidelines," based primarily upon the gross income of the parents. We can assist you in making sure that you receive all of the proper credits and considerations under the New Jersey Child Support Guidelines.

If you were required to pay child support and you later discover from DNA that you are not the child's biological parent, you may be entitled to file what is called a reimbursement lawsuit against the biological father or mother.

Emancipation

Child support does not stop automatically. You must make an application to terminate child support with the Court that entered the child support order based upon emancipation. New Jersey mandates that certain requirements be met before emancipation of a minor is granted to ensure the child is competent to care for herself/himself, and that emancipation is in the child's best interests.
